Terms & Conditions

Last Updated: 8/29/26

DO NOT USE THE SITE OR SERVICES FOR A MEDICAL EMERGENCY. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO IMMEDIATELY TO THE NEAREST EMERGENCY ROOM. IF YOU ARE HAVING THOUGHTS OF HARMING YOURSELF, CALL OR TEXT 988.

Welcome to Billie Jean Health. These Terms and Conditions (“Terms”) govern your access to and use of www.billiejeanhealth.com (the “Site”) and the services we provide (the “Services,” as defined in Section 1).

Billie Jean Health PLLC (“Billie Jean Health,” “the Practice,” “we,” “us,” or “our”) is a Texas professional limited liability company and a licensed medical practice, owned by Lauren Leavitt, MD. Texas Medical License No. P5406.

By accessing the Site, creating an account, completing an intake form, or scheduling or receiving a Service, you agree to be bound by these Terms. If you do not agree, do not use the Site or the Services.

1. Our Role and Your Care

Who provides your care. Clinical services are provided by licensed physicians and, where clinically appropriate and permitted by law, by nurse practitioners or physician assistants practicing under a physician’s delegation and a prescriptive authority agreement (each a “Provider”). All Providers are employed by or under contract with the Practice and are licensed in the state where you are located at the time of care. You may be seen by a Provider other than Dr. Leavitt, and you may ask at any time which Provider is responsible for your care or request a different one.

The Site is not medical advice. All content made available on the Site - text, graphics, images, video, program descriptions, educational material, and any automated or AI-assisted feature — is provided for general informational purposes only. It is general, not individualized to you, and it is not medical advice, diagnosis, treatment, or a recommendation of any kind. Only information you receive directly from your Provider in the course of an established treatment relationship is medical advice.

Non-clinical staff do not give medical advice. Our scheduling, billing, support, and administrative personnel are not clinicians. They do not provide medical advice, do not make clinical decisions, and are not authorized to speak for any Provider about your care. Do not act on information from non-clinical staff as though it were medical advice.

Clinical judgment governs. Your Provider exercises independent professional judgment in every clinical decision. Completing intake, paying a fee, enrolling in a program, or requesting a specific medication does not entitle you to any diagnosis, treatment plan, medication, dose, refill, or product. Your Provider may decline to treat you, decline to prescribe, or discontinue treatment based on clinical judgment.

Not a substitute for primary care. The Services address a defined set of wellness, metabolic, and hormonal concerns. They do not replace a primary care physician, an in-person examination, or care for conditions outside that scope. You should maintain a relationship with a primary care provider, inform your Provider of all other care and medications you receive, and seek in-person care when you are unwell.

Definitions. “User” means anyone who accesses the Site. “Patient” means a User who has established a treatment relationship with a Provider. “Services” means the clinical services provided by the Practice and its Providers together with the related administrative, scheduling, and technology services we provide; the Site is referred to separately and is not itself a Service. “Billie Jean Parties” means Billie Jean Health PLLC together with its members, managers, officers, employees, contractors, agents, and licensors.

Who each obligation applies to. Provisions concerning intake, clinical care, testing and monitoring, prescriptions, pharmacy fulfillment, and payment for clinical services or products apply only to Patients. All other provisions apply to every User. Where these Terms say “you,” they mean whichever of the two the provision addresses.

2. Medical Disclaimers and Emergency Notice

Not for emergencies. The Site and the Services are not intended for medical emergencies, urgent conditions, or any situation requiring immediate attention. Call 911 or go to the nearest emergency room.

No treatment relationship via the Site. Browsing the Site, submitting an inquiry, or creating an account does not create a provider-patient relationship. A treatment relationship is established only after you complete the required intake forms, clear identity verification, and consult with a Provider who accepts you as a patient.

No guaranteed outcomes. Results from weight management, hormone optimization, and wellness treatment vary by individual. We do not guarantee any particular outcome, degree of improvement, or result from any Service, program, or medication.

3. Eligibility and Account Registration

Age and capacity. The Site and the Services are available only to individuals who are at least 18 years of age and able to form a binding contract. We do not knowingly permit anyone under 18 to register an account or collect information from anyone under 18. If we learn that a User is under 18, we will terminate the account.

Where we practice. We provide clinical services only to Patients physically located in Texas. You agree to accurately report your physical location at the time of each visit, and you understand that misreporting your location may void your treatment relationship and any prescription written.

Your account. You agree to provide accurate, current, and complete information at registration, including a truthful health history, and to keep it updated. You are solely responsible for safeguarding your password and for all activity under your account. Use a strong, unique password and notify us immediately at info@billiejeanhealth.com if you suspect unauthorized access. We are not liable for losses arising from your failure to secure your credentials. You may not register under another person’s name or use an offensive or misleading username.

4. Cash-Pay Model and Insurance

Fee-for-service. We operate as a concierge, fee-for-service, cash-pay practice. Payment is due at the time of scheduling, service, or order placement, as described in Section 8. We do not operate on a recurring subscription basis unless you separately enroll in writing in a specific recurring program, in which case the fee, billing interval, and cancellation method will be disclosed before you are charged, and you may cancel in accordance with that program’s terms and applicable law.

No insurance billing. We do not participate in, contract with, or submit claims to any commercial health plan, Medicare, Medicaid, TRICARE, or any other federal or state healthcare program. All amounts are your out-of-pocket responsibility.

Federal healthcare programs. The Services are not covered by and will not be paid for by Medicare, Medicaid, or any other federal or state healthcare program. No claim will be submitted on your behalf, and you agree not to submit any claim for reimbursement for the Services to Medicare, Medicaid, or any other federal or state healthcare program. If you are a Medicare or Medicaid beneficiary, tell us before your first visit so we can determine whether we may lawfully accept you on a private-pay basis.

Superbills. On request, we may provide an itemized receipt (superbill) that you may submit to a commercial insurer for possible out-of-network reimbursement. We make no representation that any amount will be reimbursed, and verifying your out-of-network benefits is your responsibility. Superbills are not available for services rendered to beneficiaries of federal or state healthcare programs.

5. Services, Clinical Discretion, and Prescriptions

Scope. The Services include concierge medical consultations, weight management programs, hormone optimization therapy, telemedicine visits, laboratory ordering, and general wellness treatments.

Nothing is guaranteed. All clinical assessments, laboratory evaluations, treatment plans, and prescriptions are issued at the sole professional discretion of your Provider. See Section 1.

Required testing and monitoring. Hormone therapy and certain weight-management medications require laboratory testing before treatment and periodically during care. A Patient who declines required testing, monitoring visits, or follow-up may have treatment suspended or discontinued.

Controlled substances. Certain medications, including testosterone and other hormone preparations, are controlled substances. Our Providers prescribe them only after a clinical evaluation satisfying all applicable federal and state requirements, including the Ryan Haight Act and any DEA telemedicine requirements then in effect, and we participate in prescription monitoring as required by Texas law. Federal telemedicine rules for controlled substances are subject to change, and the availability of tele-prescribing for any controlled substance may change or end without notice, which may require an in-person evaluation before further prescribing. You agree to obtain controlled substances only from us while under our care for that condition, and to disclose any other controlled substance prescriptions you receive.

Off-label and non-FDA-approved uses. Some medications may be prescribed for uses not approved by the FDA. Your Provider will discuss this with you where applicable. Non-prescription products and supplements offered through the Site are not intended to diagnose, treat, cure, or prevent any disease. Review all labels, warnings, and ingredient information before use.

6. Telemedicine

Licensure. Telemedicine visits are provided only to individuals physically located in a state where the treating Provider is licensed.

Informed consent to telehealth. Telemedicine involves delivering care through electronic communications, video conferencing, and store-and-forward technology. By using the telemedicine Services you acknowledge the risks and limitations, including technical failures or interruptions, the inability to perform a hands-on physical examination, the possibility that a condition may not be diagnosable remotely, and the possibility that you may be referred for in-person care. You consent to receive care via telehealth and may withdraw that consent at any time.

Technical requirements. You are responsible for a compatible device, a stable internet connection, and a private setting appropriate for a confidential medical visit.

7. Pharmacy, Prescription Fulfillment, and Compounded Medications

Pharmacy services. Prescription fulfillment and pharmacy services are provided by e-RxHub, an independent pharmacy partner (https://www.e-rxhub.com/)

Pharmacies are independent. We do not dispense medication. Prescriptions are dispensed by licensed pharmacies that are independent businesses, not owned or operated by us. We do not control the pricing, availability, fulfillment timing, counseling, packaging, or shipping practices of any pharmacy.

Your choice of pharmacy. You may ask your Provider to send your prescription to a pharmacy of your choosing. Not every pharmacy can fill every prescription — some require compounding or other specialized services. If you use a pharmacy outside our participating network, you are responsible for obtaining the medication from that pharmacy and paying it directly, and any medication cost is excluded from what you pay us.

Consent to share information. To provide the Services you request, you authorize us to share your relevant health and personal information with participating pharmacies or the pharmacy you select, laboratories, and the service providers and logistics or fulfillment vendors used to prepare and ship your medication, in each case consistent with our Privacy Policy and HIPAA Notice and limited to what is reasonably necessary.

Compounded medications.  A compounded medication is prepared by a licensed compounding pharmacy for an individual patient pursuant to a prescription. Compounded formulations that may be prescribed through the Services are limited to compounded hormone preparations and other individualized formulations that may lawfully be compounded. Compounded medications are not reviewed or approved by the FDA for safety, effectiveness, or quality in the same way as FDA-approved drugs. Whether any medication may lawfully be compounded depends on federal and state law and current FDA policy, including whether the underlying drug appears on FDA’s shortage or bulk substance lists — all of which change over time.  A compounded medication available today may become unavailable without notice, and no compounded formulation is guaranteed. Your Provider will discuss the risks, benefits, and alternatives — including FDA-approved options — before prescribing any compounded medication.

No returns. Prescription medications and pharmaceutical products cannot be returned or refunded once dispensed or shipped, except as required by law.

8. Payment, Cancellations, and Refunds

Payment. Fees for consultations, laboratory testing, programs, medications, and products are due in full at the time of scheduling or checkout. You authorize us and our payment processors to charge the payment method you provide for all amounts you incur, including amounts we collect on behalf of a pharmacy. If your payment method is declined or cannot be charged, we may suspend or cancel your order, program, or access, and you remain responsible for amounts already incurred.

Cancellations and no-shows. Cancellations and rescheduling requests must be submitted at least 24 hours before your appointment. Late cancellations and missed appointments may result in forfeiture of the consultation fee or a late-cancellation fee.

Non-refundable. Fees for completed consultations, examinations, and clinical reviews are non-refundable — the clinical service has been rendered whether or not it results in a prescription. Specialty testing kits and supplies are non-refundable once shipped.

When no prescription is issued. If, following a consultation, your Provider determines that a requested prescription product is not clinically appropriate, we will cancel the associated product order and refund any amount you paid for the medication, pharmacy fulfillment, or shipping, using the original payment method. The consultation fee is not refunded.

Chargebacks. If you dispute a charge, contact us first at info@billiejeanhealth.com so we can resolve it.

9. Products, Orders, and Shipping

All products are subject to availability. We may impose quantity limits, reject or cancel all or part of an order — including for unavailability, suspected fraud, pricing or listing errors, shipping restrictions, or operational reasons — and correct pricing or listing errors, refunding you where required. Prices are subject to change, but changes will not affect orders already accepted. Delivery dates shown at checkout are estimates and are not guaranteed. Unless stated otherwise, title and risk of loss pass to you on delivery to the address you provide. Prescription shipments are subject to the dispensing pharmacy’s own procedures.

10. Your Responsibilities

As a Patient, you agree to provide complete, accurate, and truthful information in your intake forms, health questionnaires, and consultations, and to update it as it changes. Withholding medical history, misrepresenting your identity, age, or physical location, or attempting to obtain medications fraudulently may result in immediate termination of care and referral to appropriate legal or regulatory authorities. We are not responsible for any harm, loss, or clinical outcome resulting from information you provide that is false, incomplete, or out of date.

You also agree to follow your Provider’s instructions, attend required follow-up and testing, report side effects promptly, store medications safely and never share them, and seek emergency care when appropriate.

11. Electronic Communications, Text Messages, and Signatures

Transactional communications. By creating an account you consent to receive electronic communications from us and your Provider relating to your account, appointments, consultations, prescriptions, orders, shipments, billing, and security — by email, SMS, and portal message. These are part of your care relationship and you cannot opt out of them while your account is active, though you may close your account.

Marketing communications. Marketing messages are separate and optional. Consent to marketing is not a condition of receiving any Service. You may opt out of marketing email using the unsubscribe link, and out of marketing texts by replying STOP. Message and data rates may apply; reply HELP for help. Opting out of marketing does not stop transactional messages.

Risks of unencrypted communication. Email and SMS may be unencrypted and could be read by an unauthorized person. You accept that risk when you choose to communicate by those means, and we are not responsible for unauthorized access occurring during or after transmission. Use the patient portal for sensitive clinical matters.

Electronic signatures. You agree that electronic notices, disclosures, agreements, and consents satisfy any requirement that they be in writing, and that clicking “I agree,” typing your name, or using your finger, mouse, or keypad to accept constitutes your signature. Retain copies by printing or saving them.

12. Privacy and Protected Health Information

Our Privacy Policy / HIPAA Notice describe how personal information and protected health information are collected, used, disclosed, and safeguarded. Both are incorporated into these Terms by reference. Where a conflict exists between these Terms and the HIPAA Notice with respect to protected health information, the HIPAA Notice controls.

Your records. You may request a copy of your medical records at any time in accordance with our HIPAA Notice and applicable law. We retain records for the period required by Texas law.

13. Third-Party Content, Automated Tools, and Links

Third-party content. We do not independently verify information provided by third parties, including product information supplied by manufacturers or pharmacies. Reliance on it is at your own risk.

Automated and AI-assisted tools. We may use automated systems and AI-assisted tools for non-clinical operational purposes such as scheduling, customer support, account administration, fraud prevention, security, quality assurance, and service improvement. These tools do not practice medicine and do not make clinical decisions; every clinical decision is made by a licensed Provider. Automated outputs may be inaccurate or incomplete. Do not rely on any automated output for a medical decision, an emergency, or an urgent situation. We may review interactions and outputs for quality, legal compliance, and improvement, consistent with our Privacy Policy.

Third-party links. The Site may link to third-party sites or resources. We are not responsible for their availability, accuracy, content, products, or services, and a link is not an endorsement.

14. Acceptable Use and Reviews

You may not: access or tamper with non-public areas of the Site or our systems; probe or test the security of any system or circumvent any authentication measure; scrape, crawl, or access the Site by automated means without our written consent; use the Services to build, train, or improve a competing product or service; interfere with or disrupt the Site; transmit malware or spam; impersonate any person or entity; remove or obscure proprietary notices; use our trademarks or logos without written consent; or encourage anyone else to do any of the above.

You may not submit any review, testimonial, or endorsement that is false or misleading, that is written by someone who has not actually used the relevant Service, or that fails to disclose a material connection to us where disclosure is required. We may remove content that violates these Terms or applicable law. We do not remove or suppress reviews solely because they are negative.

You may not post content that is harassing, threatening, defamatory, obscene, infringing, or unlawful.

15. Intellectual Property and Feedback

All content on the Site — text, graphics, logos, images, design, and software — is owned by Billie Jean Health PLLC or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent. All rights not expressly granted are reserved.

Your content. Content you upload — including photographs, messages, and information submitted in connection with a consultation — remains yours. You authorize us and your Provider to use and disclose it as necessary to provide the Services, to comply with law, and as described in our Privacy Policy and HIPAA Notice.

Feedback. If you voluntarily send us suggestions or feedback about the Site or the Services, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use it for any purpose without attribution or compensation. This feedback license does not apply to your health information, clinical communications, prescription information, or anything you submit to obtain medical services — that content is governed by Section 12.

16. Termination and Discontinuation of Care

You may close your account and stop using the Site at any time by contacting info@billiejeanhealth.com.

We may suspend or terminate your account or access to the Site if we reasonably believe you have violated these Terms, you create legal or safety risk, you have provided false information, or we cease offering the Services. Where practical we will notify you at the email address on your account.

Continuity of care. Closing an account does not by itself end a treatment relationship. Any decision to discontinue clinical care for a Patient rests with that Patient’s Provider, who will give reasonable written notice and a reasonable opportunity to arrange alternative care, consistent with professional obligations regarding patient abandonment. Where a Patient is receiving ongoing therapy, we will make reasonable arrangements for continuity of medication or referral during that period. You may request your records at any time under Section 12.

Survival. Sections 1, 4 (federal healthcare programs), 8 (amounts already incurred), 10, 12, 15, 17, 18, 19, and 21 survive termination, along with any provision that by its nature should survive.

17. Disclaimers, Limitation of Liability, and Indemnification

This Section limits liability only for non-clinical matters — the Site, the technology, third-party vendors, and commercial dealings. Each subsection applies only to the maximum extent permitted by law, and some states do not allow certain disclaimers, so parts may not apply to you.

“Billie Jean Parties” has the meaning given in Section 1.

The Site is provided “AS IS.” THE SITE AND ITS TECHNOLOGY FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE BILLIE JEAN PARTIES DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, WITH RESPECT TO THE SITE. We make no warranty that the Site will be uninterrupted, secure, or error-free, and we disclaim responsibility for the completeness or accuracy of general Site content, for loss or failure to transmit content, and for harm to your device or data arising from your use of the Site. This paragraph applies to the Site and technology only. It does not apply to the medical care you receive.

Independent third parties. Pharmacies, laboratories, shipping and fulfillment vendors, and payment processors are independent businesses that we do not own or control. To the maximum extent permitted by law, the Billie Jean Parties are not liable for their acts or omissions, including dispensing errors, compounding, product defects, pricing, delivery delays, or loss in transit. This does not limit our responsibility for our own Providers’ clinical decisions, including the decision to prescribe.

No guaranteed results. We do not guarantee any specific medical outcome or result from any weight loss, hormone, or wellness treatment. A disappointing result is not by itself evidence of negligence.

Exclusion of certain damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND EXCLUDING HEALTH CARE LIABILITY CLAIMS AND ANY CLAIM FOR PROFESSIONAL NEGLIGENCE, THE BILLIE JEAN PARTIES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER THEORY.

Cap. EXCEPT WHERE PROHIBITED BY LAW, AND EXCLUDING HEALTH CARE LIABILITY CLAIMS AND ANY CLAIM FOR PROFESSIONAL NEGLIGENCE, THE AGGREGATE LIABILITY OF THE BILLIE JEAN PARTIES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF FIVE HUNDRED U.S. DOLLARS ($500) OR THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RIST TO THE CLAIM.

Indemnification. To the extent permitted by law, and excluding any health care liability claim and any claim arising from the professional negligence of a Provider, you agree to indemnify and hold harmless the Billie Jean Parties from third-party claims, liabilities, damages, losses, and costs (including reasonable attorneys’ fees) arising out of: (i) information you provided that was false, incomplete, or misleading; (ii) your breach of these Terms; (iii) your misuse of any medication or product, including use contrary to your Provider’s instructions, or your sharing or diversion of a prescribed medication; (iv) your use or disclosure of information obtained through the Services; and (v) your violation of any law or any third party’s rights.

18. Dispute Resolution and Arbitration

What this Section does not cover. This arbitration agreement does not apply to any “health care liability claim” as defined by Chapter 74 of the Texas Civil Practice and Remedies Code, or to any comparable claim for medical negligence, professional malpractice, or injury arising from the provision of or failure to provide medical care. Those claims are governed by applicable law and are not subject to arbitration under these Terms.

Informal resolution first. Before starting a formal proceeding, contact us at info@billiejeanhealth.com and describe the dispute. If it is not resolved within thirty (30) days, either party may proceed as set out below.

Agreement to arbitrate. Any other dispute between you and Billie Jean Health arising out of or relating to these Terms, the Site, billing, or your account will be resolved by binding individual arbitration, except that either party may (i) bring an individual action in small claims court, and (ii) seek injunctive or equitable relief in court to protect intellectual property rights.

Opt-out. You may opt out by emailing info@billiejeanhealth.com with the subject line “Arbitration Opt-Out” within thirty (30) days of first accepting these Terms. Opting out does not affect any other part of these Terms.

Rules and process. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, as modified by this Section, and the Federal Arbitration Act governs its interpretation and enforcement. The arbitrator will be a retired judge or licensed attorney selected under the AAA Rules. Arbitration will take place by videoconference, at a location within 100 miles of your residence, or as the parties agree. If your claim does not exceed $10,000 it will be decided on documents alone unless you request a hearing or the arbitrator determines one is necessary. The award will state the essential findings and conclusions, is limited to relief on your individual claim, and may be entered as a judgment in any court of competent jurisdiction. Your share of AAA fees is governed by the AAA Rules.

No class actions. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims. If a court holds this waiver unenforceable as to a particular claim, that claim only will be severed and brought in the state or federal courts located in Harris County, Texas; all other claims will be arbitrated.

Changes to this Section. If we change this Section after you accept these Terms, you may reject the change by emailing us within 30 days of its effective date, in which case the version you originally accepted governs.

Time limit. To the extent permitted by law, any claim arising out of or relating to the Site, your account, or billing must be brought within two (2) years after it arose, or it is permanently barred. This does not apply to health care liability claims or where the law prohibits shortening the limitations period.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Subject to Section 18, any action arising under these Terms will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.

20. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the most recent revision. If a change is material, we will make reasonable efforts to notify you by email at the address on your account or by prominent notice on the Site before it takes effect. Continued use after a change takes effect constitutes acceptance. If you do not agree to a change, stop using the Services and close your account.

21. General

Entire agreement. These Terms, together with the Privacy Policy and HIPAA Notice, are the entire agreement between you and Billie Jean Health regarding the Site and the Services. Separate written agreements — including intake and treatment consents, telemedicine consent, controlled substance agreements, program agreements, and financial policies — govern their specific subject matter and control over these Terms to the extent of any conflict.

Severability. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions stay in full force.

No waiver. Our failure to enforce any provision is not a waiver of it.

Assignment. You may not assign these Terms without our written consent. We may assign them without your consent, including in connection with a merger, acquisition, or sale of assets, subject to applicable law governing the transfer of medical records.

No third-party beneficiaries, except that the Billie Jean Parties other than Billie Jean Health PLLC itself may enforce Sections 17 and 18 as intended beneficiaries.

Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.
